1. Scope, provider & contracting party
These Terms and Conditions (T&Cs) apply to all contracts, services and orders (including gift vouchers) under the brand In Frame. “In Frame” is the shared brand of two independent sole proprietorships:
- Mag. Michael Föls, MSc, Ringelseegasse 17/3, 1210 Vienna
- Martina Sattler, BA, Walcherbauer 10/5, 3343 Hollenstein an der Ybbs
The contracting party (“we” / “In Frame”) is - depending on the enquiry and the engagement - the respective acting sole proprietorship that issues the order confirmation; both invoice separately. Shared contact details: email office@inframe.at, phone 0664 9388206; further mandatory information can be found in the Imprint. We only recognise differing terms with express written consent.
2. Conclusion of contract
Enquiries via our form, by email or by telephone are non-binding. A contract is only concluded through our express order confirmation or the confirmation of a specific date.
3. Services & cooperation
The nature and scope of the photographic service result from the chosen package or the individual agreement. Image selection and artistic editing (style, cropping, colour grading) are at our creative discretion; unedited files (RAW) are not part of the service. The cooperation of the clients as well as suitable conditions on location are required for a successful outcome.
For weddings, obtaining the necessary permissions (e.g. venue, church) is the responsibility of the clients. They are likewise responsible for ensuring a clear line of sight and - where group photos are desired - for organising and arranging them. We cannot guarantee that all guests or particular scenes will be captured; expressly desired shots are to be agreed separately in advance.
4. Prices & payment
The prices agreed at the time of booking apply. Payment is made by invoice/bank transfer in accordance with the deadlines stated in the order confirmation. The remaining amount is to be settled no later than 14 days after the photographic service has been provided or after receipt of the invoice.
5. Appointments, deposit & cancellation
Agreed appointments are binding. In the event of being unable to attend, we ask for notification as early as possible; we endeavour to find a mutually agreeable rescheduling.
For weddings (and comparable individually commissioned appointments), the following also applies:
- Deposit / reservation fee: Upon conclusion of the contract, 20% of the agreed order total is due as a binding reservation fee. This deposit is non-refundable in the event of the client’s withdrawal or if the event does not take place.
- Cancellation fees upon withdrawal after payment of the deposit - in each case based on the total order amount, with the deposit already paid being credited: up to 4 weeks before the appointment 50%, up to 1 week before the appointment 90%.
If we are unable to keep an appointment for an important reason (e.g. illness, force majeure), we endeavour to provide a replacement or refund payments already made for the service not rendered.
Any statutory right of withdrawal or cancellation for consumers (see point 10) remains unaffected by the above cancellation arrangements; within an ongoing withdrawal period, the mandatory statutory provisions take precedence.
6. Gift vouchers
Gift vouchers are valid indefinitely and freely transferable. They can be redeemed for the respective shoots indicated (couple, family, portrait). A cash payout of the voucher value is not possible; for higher-value services, the difference is to be paid in addition. Redemption takes place by arranging an appointment and quoting the voucher code. When purchasing a voucher online, consumers have the right of withdrawal under point 10.
7. Copyright & rights of use
The copyright in all photographs remains with In Frame or the respective acting photographer. Clients receive a simple licence to use for the use and publication of the photos for non-commercial, private purposes. The licence to use only transfers after full payment of the fee. When publishing, a copyright/attribution credit must be placed in sufficient connection with the respective image. Commercial use, resale and any subsequent editing of the delivered images require our prior consent.
All photographs are subject to our artistic creative latitude (selection, cropping, colour grading, visual and technical means); our style is known to the clients. We carefully select the images presented for acceptance - there is no entitlement to the release of all photographs. Original files (RAW) as well as post-processing beyond the agreement are only provided upon separate written agreement and remuneration.
8. Publication
We publish selected photographs only with your consent (e.g. for portfolio, website, social media, competitions). This consent is voluntary and can be withdrawn at any time with effect for the future.
9. Liability
We are liable for intent and gross negligence. In the case of slight negligence, we are liable only for the breach of essential contractual obligations and limited in amount to the typically foreseeable damage for this type of contract. For the partial or complete loss of images due to technical defects or force majeure, we are liable only within the scope of the above provision. Liability for personal injury remains unaffected.
10. Right of withdrawal for consumers (FAGG)
Consumers within the meaning of the Austrian Consumer Protection Act have a statutory right of withdrawal under the Austrian Distance and Off-Premises Transactions Act (FAGG) in the case of contracts concluded by distance means (e.g. online, by telephone or by email) or off our business premises. No such right of withdrawal exists where the contract is concluded in person on our business premises.
Withdrawal instructions
Right of withdrawal: You have the right to withdraw from this contract within fourteen days without giving any reason. The withdrawal period is fourteen days from the day of conclusion of the contract.
To exercise your right of withdrawal, you must inform us - the respective sole proprietorship acting as contracting party (Mag. Michael Föls, Ringelseegasse 17/3, 1210 Vienna, or Martina Sattler, Walcherbauer 10/5, 3343 Hollenstein an der Ybbs; email office@inframe.at) - of your decision to withdraw from this contract by means of an unambiguous statement (e.g. a letter sent by post or an email). You may use the model withdrawal form below for this, although it is not mandatory. To meet the withdrawal deadline, it is sufficient for you to send your communication concerning the exercise of the right of withdrawal before the withdrawal period has expired.
Consequences of withdrawal: If you withdraw from this contract, we shall reimburse you all payments we have received from you without undue delay and at the latest within fourteen days from the day on which we receive notification of your withdrawal. For this reimbursement, we will use the same means of payment that you used for the original transaction, unless expressly agreed otherwise with you; you will not be charged any fees as a result of this reimbursement.
Early commencement of the service: If you have requested that the service begin during the withdrawal period, you shall pay us a reasonable amount corresponding to the proportion of the services already provided up to the point of withdrawal compared to the total scope of the agreed service.
Exceptions to the right of withdrawal
The right of withdrawal does not exist or expires prematurely, in particular in the case of:
- services that have been fully performed, if we began performance with your express consent and your acknowledgement that you lose your right of withdrawal upon full performance of the contract (Section 18(1)(1) FAGG) - this concerns in particular shoots carried out at a fixed date at your request;
- the supply of goods or digital content made to customer specifications or clearly tailored to personal needs, e.g. individually edited photo files, prints, albums or wall art (Section 18(1)(3) FAGG).
For individually agreed appointments (in particular weddings), the cancellation terms agreed in point 5 apply additionally after expiry of, or outside, the right of withdrawal.

12. Final provisions
Austrian law applies, excluding its conflict-of-law rules; mandatory consumer protection provisions of the state in which the consumer has their habitual residence remain unaffected. Should any provision be invalid, the validity of the remaining provisions remains unaffected. The place of jurisdiction is - to the extent legally permissible - Vienna; for consumers, the statutory places of jurisdiction apply.
